Terms and conditions of sale

This English translation is provided for information only. Only the French version is legally binding.

Last updated: 16/10/2026.

1. Seller

The website erp-diagnostic.fr is published by Nova Onada SLU, a single-member limited liability company under Andorran law, with its registered office at Pack Guillemo, AD500 Andorra la Vella (Principality of Andorra).
Contact: contact@erp-diagnostic.fr. Full details are given in the legal notice.

2. Purpose

These terms govern the online sale, to consumers and professionals, of a report comprising the statement of risks and pollution (ERP) and the aircraft noise statement (ENSA), prepared in PDF format from the address or cadastral reference of the property given by the customer. Placing an order implies acceptance of these terms.

3. Description of the service

  • The report is prepared from official public data (IGN, Base Adresse Nationale, noise exposure plans and other public risk databases), consulted on the date shown on the document, and from the applicable prefectoral orders.
  • The answers to the questionnaire (type of transaction, names, place of signing, statements on compensated losses) are reproduced exactly as entered by the customer. The customer is solely responsible for their accuracy.
  • It is the seller’s or landlord’s responsibility to check the document, complete it if necessary, date and sign it, and then attach it to the preliminary agreement, the deed or the lease.
  • The risk statement must be less than 6 months old at the time of signing.

4. Price

The ERP + ENSA report is sold for €9.90 including all taxes per property. Credit packs are also offered, including all taxes: 10 reports for €79, 25 for €150, 50 for €195 and 100 for €220; one credit corresponds to one report. The applicable price is the one displayed at the time of ordering. Unless there is a promotion, each report includes a free renewal under the conditions of article 7.

5. Order and payment

  • The customer enters the address or cadastral reference of the property, confirms that the property shown is the right one, answers the questionnaire and then confirms the order.
  • Payment is made online via PayPal, with or without a PayPal account (bank card). The order is final once payment has been confirmed.
  • A customer with credits in their account can use them instead of paying: one credit corresponds to one report.

5a. Credit packs

  • The credits in a pack are added to the customer’s account as soon as payment is confirmed. One credit gives one ERP + ENSA report, for the property of the customer’s choice, with free renewal included under the conditions of article 7.
  • Period of validity. Each pack has a period of validity that starts on the date one of its credits is first used: 1 month for the pack of 10 reports, 3 months for the pack of 25, 1 year for the packs of 50 and 100. A pack none of whose credits has been used expires 1 year after its date of purchase. Credits not used by the end of these periods are lost and will not be refunded. The remaining credits and their expiry date are shown in the customer area.
  • Once a credit from a pack has been used, the pack can no longer be refunded, either in full or in part, as performance of the service has begun with the customer’s express consent.

6. Delivery

The documents are sent by email and made available in the “Mon compte › Mes diagnostics” (My account › My reports) area. They are generally delivered within minutes of the order. When a regulatory check is needed (for example updating a prefectoral order), this time may be longer; the customer is informed. The documents remain available for download for 7 months: it is the customer’s responsibility to keep a copy.

7. Free renewal

Each report can be regenerated free of charge once, within 6 months of its first generation, from the “Mon compte › Mes diagnostics” area. The renewal applies to the same property.

In the event of a promotion (promo code or reduced price), the free renewal within 6 months is not necessarily offered; when it is not, the “Mon compte › Mes diagnostics” area says so for the report concerned.

8. Right of withdrawal

The report is digital content supplied without a physical medium. In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised once performance has begun with the consumer’s prior express consent and acknowledgement that they lose this right. When ordering, the customer expressly requests immediate delivery of their report and acknowledges losing their right of withdrawal by ticking the box provided for this purpose; this consent is confirmed to them by email.

9. Legal guarantee of conformity

Consumer customers benefit from the legal guarantee of conformity for digital content provided for in articles L224-25-1 et seq. of the French Consumer Code. If a document does not conform to the order, the customer can ask for it to be brought into conformity by writing to contact@erp-diagnostic.fr.

10. Liability

The seller undertakes to prepare the report with care from the official sources available on the date of consultation. The seller cannot be held liable for an error or omission originating from these sources, nor for inaccurate information provided by the customer.

11. Personal data

The data collected is processed in accordance with our privacy policy.

12. Complaints and mediation

Any complaint may be sent to contact@erp-diagnostic.fr. If a dispute is not resolved, consumer customers may use a consumer mediator free of charge.

13. Applicable law and jurisdiction

The seller is established in Andorra. These terms are governed by Andorran law.

For consumer customers, this choice cannot deprive them of the protection afforded by the mandatory provisions of the law of the country where they are habitually resident.

Any dispute with a professional customer falls within the jurisdiction of the Andorran courts. Consumer customers may bring proceedings before the Andorran courts or, where the law allows, before those of their place of residence.
