ERP report?
Most frequently asked questions
The ERP report (état des risques et pollutions, statement of risks and pollution) is a mandatory document when a property in France is sold or rented. It provides information on the natural, technological and seismic risks and the pollution (such as soil pollution) to which the property is exposed. Its purpose is to protect buyers and tenants by informing them of local environmental risks.
€9.90 €4.00 for the ERP and the ENSA, with one free renewal (once, within 6 months of the first report). (ERP report price).
The ERP (statement of risks and pollution) is mandatory when a property is sold or rented. It must be provided when the preliminary sale agreement or the lease is signed. The document is also required if the area where the property lies is covered by a natural or technological risk prevention plan or a soil pollution perimeter.
The ERP is mandatory for any owner, private or professional, who wishes to sell or rent a property located in a risk zone defined by prefectoral order. This applies to residential properties as well as to commercial or business premises. The seller or landlord must provide the document to the buyer or tenant before the transaction or the lease is signed.
The owner of the property, whether seller or landlord, is responsible for requesting and providing the ERP (statement of risks and pollution). They can prepare it themselves using the documents and information available online or from the prefecture. It is also possible to use a professional property diagnostics inspector to prepare it.
The ERP (statement of risks and pollution) is valid for 6 months. If the sale or rental takes place after this period, the document must be updated to reflect any changes in the risks.
The ERP (statement of risks and pollution) concerns all properties, whether residential, commercial, industrial or agricultural, as long as they are located in a zone exposed to natural risks (floods, earthquakes), technological (industrial) risks, mining risks or soil pollution, defined by prefectoral order. This includes houses, flats, buildings and building plots as well as business premises.
The ERP (statement of risks and pollution) measures a property’s exposure to different types of risk:
Natural risks: floods, earthquakes, ground movements, avalanches, forest fires, etc.
Technological risks: risks linked to hazardous industrial sites, nuclear sites or the transport of hazardous materials.
Mining risks: subsidence or collapse caused by mining.
Soil pollution: contaminated or potentially polluted areas.
Radon: presence of this natural radioactive gas.
The aim is to inform about the environmental safety of the property.
There is no specific fine directly linked to a missing ERP (statement of risks and pollution). However, if it is not provided or is incomplete at the time of a sale or rental, the buyer or tenant can ask for a price reduction or even the cancellation of the transaction. The seller or landlord can therefore be held liable and face civil penalties, such as financial compensation.
