The ERP report (état des risques et pollutions, statement of risks and pollution) informs the buyer or tenant of the natural, mining, technological and seismic risks, the radon potential and the pollution linked to the property’s location. In France, it is required for sales and rentals.
The ERP report is prepared from public data, on the regulatory forms currently in force. It meets the legal duty to inform buyers and tenants (IAL).
The ERP covers risks and pollution. The ENSA (état des nuisances sonores aériennes, aircraft noise statement) only applies to properties within the noise exposure plan of an airfield; otherwise, the document states “not concerned”.
The risk statement must be less than six months old when the contract is signed, and must be updated if the information it contains is no longer accurate.
